Terms of Service

Authorized Business Use

You may use DOMINANCE only for lawful business purposes and only with data, accounts, websites, advertising accounts, and third-party services that you are authorized to access. You are responsible for your users, credentials, configurations, connected accounts, and decisions made using the service.

Connected Services

DOMINANCE may connect to Google and other third-party platforms at your direction. You authorize WLG to access and process information from those services solely as necessary to provide the requested DOMINANCE functionality. Third-party services remain subject to their own terms, policies, API requirements, quotas, and availability.

Accounts and Security

You must provide accurate account information, protect credentials, and promptly notify WLG of suspected unauthorized access. You may not attempt to bypass security controls, probe systems without authorization, interfere with service operation, introduce malicious code, or obtain data belonging to another customer.

Analytics, AI and Estimates

DOMINANCE may generate automated recommendations, forecasts, opportunity scores, competitive intelligence, campaign recommendations, and other AI-assisted outputs. Some information may be estimated, modeled, inferred, delayed, incomplete, or dependent on third-party data. DOMINANCE does not guarantee business results, advertising performance, search rankings, revenue, market share, or the accuracy of every prediction or recommendation.

Customer Data

As between you and WLG, you retain rights in data you lawfully provide or authorize DOMINANCE to access. You grant WLG the rights necessary to host, process, secure, analyze, transform, and display that data for operation of DOMINANCE and provision of contracted services.

Intellectual Property

DOMINANCE, its software, architecture, interfaces, algorithms, models, scoring systems, workflows, documentation, branding, and related WLG technology are owned by WLG or its licensors and are protected by applicable intellectual-property laws. Except for rights expressly granted in an applicable written agreement, no ownership rights are transferred to users.

Prohibited Use

You may not resell or sublicense DOMINANCE except under a written WLG agreement; reverse engineer or copy protected portions of the platform except where law expressly permits; use the service to violate privacy, intellectual-property, advertising, consumer-protection, computer-security, or other laws; or use unauthorized credentials or data.

Availability and Changes

We may update, modify, add, suspend, or discontinue features as the platform evolves. We do not guarantee uninterrupted availability, particularly where functionality depends on third-party APIs, networks, cloud providers, data suppliers, or authorization systems.

Fees

Paid services are governed by the applicable order, proposal, subscription, statement of work, or other written commercial agreement. Unless that agreement states otherwise, fees are non-refundable once the applicable service period has begun.

Disclaimer

To the maximum extent permitted by law, DOMINANCE is provided on an "as is" and "as available" basis. WLG disclaims warranties not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, WLG will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, goodwill, or business opportunities arising from use of DOMINANCE. Any additional or different liability terms in a signed agreement between WLG and the customer will control.

Termination

WLG may suspend or terminate access for material breach, unlawful use, security risk, nonpayment, or as otherwise permitted by an applicable agreement. Upon termination, authorization to use DOMINANCE ends, subject to provisions that by their nature survive termination.

Changes to These Terms

We may update these Terms as DOMINANCE evolves. The effective date above identifies the current version. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
